Sri C. Ramaiah Reddy v. Deputy Commissioner of Income Tax, Central Circle-2(2), Bangalore

Income Tax Appeal No. 365 of 2015 ·

Deletion of addition of Rs. 6,74,320/- under Section 69B for AY 2011-12 based solely on a District Valuation Officer (DVO) valuation report prepared pursuant to a search conducted in FY 2011-12 (AY 2012-13) without any incriminating material showing undisclosed investment in AY 2011-12.

1. FACTS OF THE CASE

Pursuant to a search under Section 132 conducted during FY 2011-12 (relevant to AY 2012-13), the Assessing Officer referred the valuation of the assessee's building construction to the DVO and, based on the valuation differential, made an addition of Rs. 6,74,320/- as unexplained investment under Section 69B for AY 2011-12. The ITAT sustained the addition by order dated 27.03.2015.

2. DISCUSSION BY THE COURT

The Division Bench observed that no incriminating document or evidence was found during the search to show that the assessee had incurred any unrecorded construction expenditure during FY 2010-11 (AY 2011-12). Furthermore, because the physical inspection and search took place in FY 2011-12 (AY 2012-13), any alleged excess investment noticed at the time of search could only be considered, if at all, in the assessment year corresponding to the search (AY 2012-13) and could not be arbitrarily apportioned to AY 2011-12 under Section 69B.

3. JUDICIAL DECISION

Answering the substantial questions of law in favour of the assessee and against the Revenue, the High Court allowed the appeal and set aside the ITAT order sustaining the addition of Rs. 6,74,320/- for AY 2011-12.

4. OUTCOME

5. AKHB REVIEW POINT

An addition under Section 69B in a Section 153A assessment cannot be made in an earlier assessment year merely by spreading back a DVO valuation estimate without seized material proving unrecorded expenditure in that specific financial year.
